These Terms and Conditions (“Terms”) govern your access to and use of Rodeo (the “Service”), operated by MITH UG (haftungsbeschränkt) (“MITH”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Rodeo Is

Rodeo is a parimutuel sports prediction game where players use virtual in-game coins to bet on the outcomes of real-world sports events. Rodeo is sold to organizations (employers, teams, communities) on a per-seat licence; individual players play free under their organization’s licence, or via a public free tier.

Rodeo is not gambling. Players use virtual coins with no cash value, no cash-out path, and no real-money awards. Coins exist solely within the Service to track game progression and leaderboard standing. They cannot be transferred between accounts, sold, redeemed, or exchanged for anything of monetary value. Rodeo does not offer prizes, payouts, or any benefit of monetary value contingent on game outcomes.

2. Account Requirements

To use Rodeo you must:

  • Be at least 18 years old
  • Provide accurate signup information (real email, valid nickname)
  • Keep your password secure and not share your account
  • Use the Service in compliance with applicable laws

You are responsible for all activity on your account. If you believe your account has been compromised, contact security@rodeo.ad immediately.

3. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to other accounts, our systems, or any data not intended for you
  • Create multiple accounts to manipulate leaderboards, league standings, or pool dynamics
  • Use bots, scripts, or any automated means to play or place bets
  • Reverse-engineer, decompile, or otherwise attempt to extract source code or proprietary algorithms (parimutuel math, settlement logic, etc.)
  • Harass, abuse, or harm other players via in-game chat, league names, nicknames, or avatars
  • Use names, avatars, or content that infringe third-party intellectual property
  • Resell, sublicence, or commercially redistribute access to the Service without our written permission
  • Use the Service in any way that disrupts or degrades it for other users
  • Circumvent rate limits, paywalls, or any other technical protection measure

Violation of these terms may result in immediate account suspension or termination, removal of leaderboard standings, and forfeiture of any in-game coins or items.

4. Arena Types and Pricing

Rodeo offers two Arena types:

  • Open Arena (free): every account is auto-joined at signup. No coin cost and no paid items; players are ranked by percentage of correct predictions.
  • Private Arena (€19.95 one-off): the creator pays a single €19.95 charge to open a Private Arena and invites players via a 6-character invite code. No seat cap this round. Items are enabled and players are ranked by coin balance.

Prices are in EUR and include VAT where applicable. We may change prices at any time; an existing paid Arena retains the price it was created at for the current competition cycle.

5. Payments and Refunds

Paid Arena purchases are processed by Stripe Payments Europe Ltd. Your payment data is handled by Stripe under their own privacy policy and is not stored by MITH.

Refunds: a paid Arena is refundable within 14 days of purchase under EU consumer-protection law, provided no game activity has occurred in the Arena. Once players have placed bets in a paid Arena, refunds are not available because play has begun. Contact billing@rodeo.ad for refund requests.

6. Virtual Coins and Items

In-game virtual coins, items (Strike, Steal, Gamble, Trap), tournament picks, and leaderboard standings are NOT property, NOT redeemable for real-world value, and NOT transferable between users or to any third party. We may at our discretion adjust coin balances, reset leaderboards, correct settlement errors, or invalidate game outcomes if a technical issue, bug, or abuse is detected.

We make no warranty that any specific coin balance, item count, or leaderboard standing will persist between competition cycles. After a competition cycle ends (e.g., WC2026 final settlement), coin balances and leaderboards may be reset for the next cycle.

7. Game Rules

The mechanical rules of the game (parimutuel settlement, item effects, match resolution, deflationary void, KO Phase Reset, etc.) are made available within the Service and apply to your play. By playing, you accept the Game Rules as in effect at the time you play. We may update the Game Rules; we will surface material changes with at least 7 days’ notice within the Service before they take effect on live competitions.

8. Intellectual Property

The Service, including its design, code, game mechanics, character art, copy, brand assets, and underlying technology, is owned by MITH and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for the duration of your account, solely for personal use (or, in the case of a paid B2B seat, for the use of the licenced employee).

User-generated content (Arena names, Squad names, Nicknames, avatars): you retain ownership; you grant MITH a worldwide, royalty-free licence to host and display this content as necessary to operate the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The Service will meet your specific requirements
  • Game outcomes will be settled at any specific time
  • Real-world sports outcomes (which determine settlements) will be reported correctly by third-party sources

Sports outcomes are sourced from third-party data providers. Where a clear error is identified in a third-party source after settlement has occurred, we may at our discretion re-settle affected matches, restore coin balances, and re-rank leaderboards.

10. Limitation of Liability

To the maximum extent permitted by law, MITH’s total liability arising out of or relating to the Service is limited to:

  • For free accounts: €100 in the aggregate
  • For paid League purchases: the amount paid by the purchaser for the League seat(s) in the 12 months preceding the claim

MITH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF MITH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for intentional misconduct, gross negligence, or death/personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold harmless MITH, its officers, employees, and affiliates from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of applicable law, or your infringement of any third party’s rights.

12. Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, the Game Rules, or applicable law. We may also terminate or suspend the Service in whole or in part at any time.

You may terminate your account at any time via Settings → Account → Delete account or by emailing privacy@rodeo.ad. Deletion is processed within 30 days per our Privacy Policy.

Sections that by their nature should survive termination will survive (including without limitation IP, disclaimers, liability limits, governing law).

13. Changes to These Terms

We may update these Terms from time to time. For material changes affecting your rights, we will notify you via the email address on your account at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may request account deletion.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without reference to its conflict-of-laws principles. The UN Convention on the International Sale of Goods (CISG) does not apply.

For consumers (B2C), the mandatory consumer-protection law of your country of residence applies in addition to these Terms.

The non-exclusive place of jurisdiction is Berlin, Germany, to the extent permitted by law.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is replaced by a valid one that most closely approximates its intent.
